Mobile phones are an essential tool for both our personal and private lives. As such many people are using them whilst driving their cars. Unless you are using a hands free kit you are at risk of being stopped by the Police and prosecuted.

You will face 3 penalty points and a fine.

HOWEVER, you could have a defence. The Police have to prove that the phone was being held when the course of making or receiving a phone call or some other function such as texting.

It is for the Police to prove this.
